Welcome to PinSide. These Terms and Conditions ("Terms") govern your use of the PinSide website (pinside.golf), our video capture services at golf courses and events, and any content, clips, or communications you receive from us (collectively, the "Service"). By participating in a PinSide event, scanning a QR code, tapping an NFC tag, opting in to receive a clip, or otherwise using the Service, you agree to these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Who We Are

2. What the Service Does

PinSide places cameras at designated tee boxes (typically par-3 holes) at golf courses and events to capture footage of golfers taking their shot. That footage is reviewed and edited by a member of our team, may include sponsor branding or overlays, and is delivered to the golfer via text message (SMS) or another method you provide, based on identification through a QR code scan or NFC tap at the tee.

We do not require you to download an app to use the Service.

3. Consent to Being Filmed

By playing a hole where PinSide cameras are active, or by participating in an event using PinSide's service, you acknowledge that:

  • Cameras will record video of golfers at that location, including you and your likeness, voice, and swing.

  • This footage may be edited into a short branded video clip.

  • Your clip may include the branding, logo, or sponsored content of a business or organization sponsoring that hole or event.

  • Footage is reviewed and selected by a person before delivery; we do not use fully automated systems to identify golfers.

If you do not wish to be filmed, please let the event organizer or course staff know before playing the relevant hole, or avoid the designated camera location.

4. Opt-In and Delivery

To receive your personalized clip, you must opt in by scanning a QR code, tapping an NFC tag, or providing your mobile number or email through another method we make available at the event.

By providing your phone number, you consent to receive one or more text messages from PinSide related to your video clip. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of future messages at any time. Reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

We are not responsible for failures to deliver a clip due to an incorrect phone number or email address provided by you, network issues, carrier filtering, or similar circumstances outside our control.

5. Ownership of Footage and Clips

PinSide retains ownership of all raw footage captured at an event. Once we deliver your personalized clip to you, you are granted a personal, non-exclusive, royalty-free license to view, save, and share that clip for your own personal, non-commercial use, including posting it to your personal social media accounts.

PinSide and its sponsors retain the right to use footage and clips (including footage in which you appear) for PinSide's own promotional, marketing, and business purposes, including but not limited to sponsor advertising, PinSide marketing materials, and demonstration content, unless you notify us that you do not consent to such use.

If you would like a clip removed from PinSide's own marketing use, contact us at [CONTACT EMAIL] and we will make reasonable efforts to accommodate your request.

6. No Guarantee of Capture or Delivery

We make reasonable efforts to capture and deliver a clip for each golfer who opts in, but we do not guarantee that every shot will be captured, that footage will be usable, or that a clip will be delivered. Cameras may fail, weather and lighting conditions vary, and human editorial review means not all footage is selected. PinSide is not liable for any golfer's failure to receive a clip.

7. Sponsor Content

Clips may include the name, logo, branding, or promotional content of one or more sponsors of the hole or event. Sponsors are independent businesses and are not responsible for operating the Service. PinSide does not endorse, and is not responsible for, the products, services, or claims of any sponsor featured in a clip.

8. Eligibility and Minors

The Service is intended for use by individuals of any age participating in golf events, but SMS opt-in and delivery is intended for individuals who are at least 18 years old or who have the involvement of a parent or guardian. If a minor is captured on camera and a parent or guardian wishes to opt in on the minor's behalf, the parent or guardian consents to these Terms on the minor's behalf.

9. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable law

  • Attempt to interfere with, damage, or gain unauthorized access to PinSide equipment, cameras, or systems

  • Misrepresent your identity or another person's identity when opting in to receive a clip

  • Use clips featuring other golfers without their consent

10. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. PinSide does not warrant that the Service will be uninterrupted, error-free, or free of technical issues.

11. Limitation of Liability

To the fullest extent permitted by law, PinSide and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or business opportunity, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

PinSide's total liability for any claim arising from the Service will not exceed the amount, if any, paid by you (not a sponsor) directly to PinSide for the Service in question.

12. Indemnification

You agree to indemnify and hold harmless PinSide and its owners and operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

13. Intellectual Property

The PinSide name, logo, website, and related materials are the property of PinSide and may not be used without our prior written permission. Editing techniques, overlays, and branded templates created by PinSide remain our intellectual property.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Virginia.
